FL. Lawsuit likely after Osceola school fight

The attorney for a student, who was allegedly beaten at school by a classmate, said the family is likely to file a lawsuit against the Osceola County School District.

Last week, Channel 9 reported on the story of two special needs students fighting at Discovery Intermediate School.

The fight was captured on cellphone video.

Following the brawl, three students were arrested for aggravated battery. Two teacher’s aides, Kristie Gilmore and Mona Sagar, were charged with child neglect after investigators said they did nothing to stop the fight or call for help.

The attorney for the young man who was said to have been beaten by his classmate said a lawsuit is likely.

“He was relying on the school and the teachers to take care of him, and they have failed in that regard and at this point we are going to the courts seeking justice,” said attorney Charles Smith. “The thing that his family is most concerned about with right now is getting him into a classroom where he can feel safe and feel he is not having to defend himself both from the students and teachers when he is being threatened.”

Smith also said the boy may go back to the school, but there is a possibility that he could transfer.
